Terms of Service

1. What this service is

BattleMyPhoto turns a group photo you upload into a short, stylized, AI-generated parody battle video. The winner is chosen randomly by our system for entertainment. Generated videos are fictional parody — they do not depict real events and must never be presented as real.

2. 18+ only

This app is for users 18+ only. Do not upload photos of minors. We reject photos that appear to contain minors and remove reported content involving minors immediately.

3. Your photo, your responsibility

• You may only upload photos you have permission to use, showing people who are all 18 or older and who are okay with being in the video.
• You are responsible for the content you upload and the consent behind it.
• Before every generation you must confirm this via the required consent checkbox; we store that confirmation with a timestamp.

4. Acceptable use

You must not use this service to create or attempt to create:

• harassment, bullying, shaming, or revenge content targeting anyone;
• explicit, sexualized, or nude content;
• content involving minors in any form;
• misleading content about public figures or implied endorsements;
• realistic violence, gore, injuries, or weapon attacks;
• hateful, extremist, or discriminatory content;
• content implying the generated events really happened.

Uploads are checked by automated moderation and may be rejected or paused for review.

5. AI-generated content and labeling

• Every result is labeled as an AI-generated parody video.
• Free exports include a visible watermark. All exports — free and paid — carry machine-readable AI-generation marking embedded in the video file (EU AI Act Art. 50).
• Paid watermark removal removes only the brand watermark, never the AI-generation label or the machine-readable marking.

6. Credits and payments

• Prices are shown in EUR. Payment is processed by Stripe; we never see your card.
• 1 credit = 1 generation or rematch.
• Credits are added to your account only after your payment is confirmed by our payment provider.
• “If generation fails technically, your credit is returned automatically. If the video generates successfully, the credit is used.”
• There is no automatic refund if you dislike the output, dislike the winner, or change your mind after a successful generation. Our support can review billing issues and severe quality failures manually.
• If a generated result is blocked by our safety checks after you paid, the credit is returned.
• Purchased credits are for use in this app and have no cash value.

7. Reports, removal, and deletion

• Every result page has Report and Delete. Anyone — including people who appear in a photo — can report content; you do not need an account.
• Severe reports (minors, non-consent, explicit content, harassment, public-figure misuse, unsafe violence) hide the content immediately pending review.
• Deleting a result disables its link and removes the uploaded photo and generated video from access. Minimal records required for payments, fraud prevention, and legal compliance are preserved.

8. Termination

We may block sessions or accounts and remove content for abuse of these terms — including uploading minors, harassment, attempts to bypass safety systems, or payment fraud. No refund is owed for credits forfeited through abuse. [OPERATOR: confirm forfeiture position with counsel.]

9. Liability and changes

The service is provided “as is” during beta; output quality is not guaranteed (failed generations are not charged, see section 6). We may update these terms; material changes will be announced on this page. [OPERATOR: add governing-law and liability clauses with counsel.]
